We are often asked as to whether you need motor insurance for your fork lift truck, even though it is not used on the road. The answer to this is "yes" if you use it in an area where the public have access . The reason for this is that the road traffic act stipulates that the vehicle must have valid insurance for use on the road or use at any other public place. This can include builders yards, docks, industrial estates, car parks, unadopted road, footpaths, bridleways, cycle tracks, private land.
Places that have cases that demonstrate them to be public places are:
1. A Multi Storey car park (Bowman v DPP [1991] )
2. The "Inward Freight Immigration Lanes" situated Dover Eastern Docks (DPP v Coulman [1993] )
3. A Caravan site that is privately owned but open to campers (DDP v Vivier [1991] )
4. A school playground used outside after school hours by members of the public as a leisure park (Rodger v Normand 1994 )
5. A field used for an agricultural show (Paterson v Ogilvey 1957 SLT 354)

In order to maintain the safety of your forklift truck, it is important to check that your forklift truck is safe to use and free from damage. The operator should complete regular checks and record their findings.
Why is it important to check the forklift truck?
Using a forklift truck that is damage is a hazard and potentially unsafe. It is because of this that operators have a legal duty to check their vehicle prior to use. However, all too often these checks are just a visual inspection and are never recorded. It is recommended that you create a forklift inspection record to record the findings of these inspections
What checks should be undertaken prior to use of the forklift?
It is recommended that the operator checks for the following
Damaged or missing parts of the forklift
The forklift mast
The forks
The forklift chains
the hydraulic hoses and connections
The tyres and wheels
The coolant levels
The engine and hyraulic oil levels
The charging lead and connectors
How often should the forklift be inspected?
This depends on the frequency of use. If you use the forklift every day, it is recommended that you undertake a daily check. However if they are used less frequently it is likely that weekly checks of the forklift will be sufficient
