Minibuses - Section 19 and Section 22 permits
Some organisations and businesses can apply for a Minibus Permit for vehicles that are able to carry between nine and sixteen passengers. (This comes under Section 19 of the Transport Act 1985). This Permit allows organisations such as charities, education, religion, social welfare, recreation and other volunteer or community activity groups to make a charge for their services without having to comply with the full passenger carrying vehicle operator licensing requirements and without the need for their drivers to have PCV entitlement. However there are restrictions for volunteer minibus drivers who passed their car driving test after 1 January 1997. They are restricted in the vehicles they can drive as they are not allowed to drive minibuses which weigh more that 3500 kgs gross vehicle weight.
Schools and other educational establishments do not normally need a Section 19 permit if they do not charge for the minibus service. A driver of a Section 19 permit minibus can be paid or can be an unpaid volunteer
Many charities or community based organisations operate minibuses under a Section 19 permit which allows for the service being provided for its own members or for groups of people whom the organisation was set up to provide a service. These organisations can charge for providing the transport, but it must be on a non profit making basis.
The Local Transport Act now allows Section 19 permits to be used for vehicles of 8 or less seats (at separate fares).
A Section 22 (Transport Act 1985) permit allows a minibus to be operated as a local bus service but it must be on a non-profit basis
